Delhi HC Stays Order Directing Amazon To Pay Rs 340 Cr

The Delhi High Court (HC) has stayed a single judge bench’s order asking ecommerce major Amazon to pay Rs 340 crore damages to apparel brand Lifestyle Equities in a trademark infringement case. The bench of justices Hari Shankar and Ajay Digpaul passed the interim order.

Amazon’s application sought a stay of Justice Prathiba M Singh’s 25 February ruling. The reports noted that the application was preferred in Amazon’s appeal against the order that concluded that the company had infringed upon the Beverly Hills Polo Club (BHPC) trademark.

Earlier, in 2020, Lifestyle Equities filed a trademark infringement suit against companies including Amazon Technologies. As per the reports, the company alleged that they infringed upon its registered BHPC logo or device marks. It alleged that these companies were using a deceptively similar mark on apparel and other items that were being sold on their platforms.

“The considerations outlined herein above make out, in our considered opinion, an exceptional case, in which it would be a complete travesty of justice to require the Appellant Amazon Tech to deposit, or secure, any part of the amount decreed by the impugned judgment, in order to maintain its appeal,” the order read.

The reports noted that the division bench emphasised that the single judge awarded Rs 336 crore against Amazon despite original claims of Rs two crore. No amended pleadings were made to support the enhanced figure, the reports added.
