The Delhi High Court has directed ecommerce platform Meesho to take down innerwear products that carry names such as ‘Joyke’, ‘Joyebee’, ‘Joyess’ and ‘Jojoke’. The court observed that these are deceptively similar to the registered ‘Jockey’ trademark, as per the reports.
In an interim order passed last month, the HC has asked the ecommerce company to disclose the details for the sellers behind the listings. Earlier, Jockey had approached the court alleging a trademark violation by the sellers on Meesho.
The report added that Jockey said that it discovered the listings that violated the trademark in January and also identified additional sellers using related names. The company alleged that the operation continued despite the issuing of a cease-and-desist notice.
The Delhi HC has restrained the sellers from manufacturing, marketing or selling such nature of product by granting an ex parte interim injunction, as per the report. The court also directed the ecommerce platform to block the identified listings within 36 hours and provide the sellers’ details within four weeks.
The report pointed out that the court has directed the company to provide the KYC details, registered addresses, transaction records, mobile numbers, UPI details and IP logs of the infringing companies. Advocates Saif Khan, Shobhit Agrawal and Diya Viswanath appeared for Jockey and the next date of hearing is on 24 September.
