Delhi High Court restrains Cartel Bros, backed by Sanjay Dutt, from promotions; launch of disputed whisky brand deferred
Devans Modern Breweries Limited has approached the Delhi High Court alleging trademark infringement against Cartel Bros, a venture backed by actor Sanjay Dutt, over the branding of its upcoming Glenwalk whisky.
In its plea, Devans contended that the defendants had adopted the “Godfather” mark, identical to its registered trademark used for its flagship beer brand and were seeking to use it in relation to Glenwalk whisky. The company argued that the “Godfather” mark enjoys significant goodwill and market recognition in India, supported by multiple trademark registrations, and that its use for whisky would amount to infringement and passing off.
After hearing submissions, the Court recorded an undertaking from Cartel Bros to defer the commercial launch of Glenwalk whisky under the impugned mark until the next date of hearing.
The Court also issued an interim direction restraining the defendants from releasing any fresh promotional or social media content linked to the product bearing the “Godfather” branding.
The matter is now listed for further hearing at a later date.
