The US International Trade Commission (ITC) has reportedly opposed Apple’s petition seeking a stay in a case involving the sales of its flagship device, smartwatches, according to a media report on Thursday.
This is regarding a complaint by California-based tech company Masimo which allegedly claimed that Apple had infringed its patents. Earlier, ITC had considered the matter and restricted Apple’s smartwatches sale. However, Apple immediately filed an emergency request asking the US Court of Appeals for the Federal Circuit to halt the order.
Apple’s plea was accepted in the court, successfully pausing the commission’s ban. Post the legal order the tech major underscored that its Series 9 and Ultra 2 watches would be back on sale in Apple stores and website.
Meanwhile, even though Apple is back in the market with its flagship device. Masimo’s allegations are serious claiming the stealing of its pulse oximetry technology and incorporating it into its watches, disrupting the steadfast faith among consumers.
It is reportedly said that Masimo’s CEO Joe Kiani is willing to settle the dispute, but Apple had sued the California-based firm alleging that its legal actions were a strategic move to eliminate competition for its smartwatch.
